1. Scope and Applicability

These Terms & Conditions (“T&Cs”) govern all purchases, rentals, memberships, and services provided by Capsule AG (“Capsule,” “we,” “our,” or “us”) through our online shop and digital services hosted on Shopify and related platforms.

Our services include, where available, digital and AI-powered services such as the Yves AI Styling Coach.

By placing an order, purchasing or using a membership, or accessing a digital service that refers to these T&Cs, you agree to be bound by them.

These T&Cs apply exclusively to consumers residing and purchasing within Switzerland.

3. Accounts

Customers may create personal accounts to manage orders, memberships, and preferences.

Account holders are responsible for keeping their login information confidential and for activities performed through their account. Please notify Capsule promptly if you believe that your account has been accessed without authorisation.

4. Products Offered

4.1 New Goods

We sell new goods from partner brands. Unless otherwise stated, all items are fulfilled directly by Capsule from our own inventory.

Delivery times displayed on our website or at checkout are estimates.

4.2 Secondhand Goods

Capsule sells secondhand items that we have purchased and resell.

Secondhand goods may show signs of previous use. Normal wear and tear and any flaws, repairs, alterations, or signs of use clearly disclosed in the product description, condition rating, or photographs do not constitute defects.

The warranty provisions for secondhand goods are set out in Section 10.

4.3 Rentals

Certain products may be available for rental.

Rental items must be returned on time and in substantially the same condition in which they were supplied, subject to reasonable wear resulting from proper use. The rental period begins on the day delivery is first attempted by the carrier and ends on the day the return package is scanned and accepted by the designated postal or delivery service. Late returns may be subject to a daily late fee of CHF 15.00, up to the original retail value of the item.

If a rental item is lost, stolen, or damaged beyond reasonable wear and tear, Capsule may charge the reasonable replacement value of the item, not exceeding its original retail price.

Capsule will document the condition of returned rental items. Customers may provide photographs or other relevant evidence if they disagree with Capsule’s assessment.

5. Memberships and Subscriptions

Capsule may offer free or paid memberships with benefits such as newsletters, access to selected collections, discounts, digital tools, or AI-powered styling services.

The benefits, price, and billing cycle applicable to each membership are displayed on our website at the time of registration or purchase. Memberships are personal and non-transferable.

Paid memberships may be cancelled through the customer account or by contacting Capsule. Unless otherwise stated, cancellation takes effect at the end of the current billing period. No refund is provided for a partially used membership period, except where required by law or expressly stated otherwise.

Capsule may change membership benefits or pricing. Material changes affecting an existing paid membership will be communicated in advance. You may cancel the membership before the changes take effect.

6. Digital and AI-Powered Services

6.1 Digital Services Generally

Capsule may provide digital services including AI-powered styling tools, styling simulations, outfit recommendations, fitting-room simulations, and assistance with sourcing secondhand goods.

The availability and functionality of these services may vary.

6.2 Yves AI Styling Coach

Yves is an automated styling assistant powered by artificial intelligence. Its responses are generated by a machine and are not reviewed or provided by a human stylist unless expressly stated otherwise.

Yves is currently provided free of charge as part of the Capsule experience. Capsule may introduce different features, access conditions, or paid services in the future. Any applicable price will be clearly communicated before purchase.

Yves is intended for use by adults.

6.3 Accuracy and Reliance on AI Output

AI-generated responses may be incomplete, inaccurate, inconsistent, or unsuitable for an individual user. Recommendations are provided for general styling inspiration and information only. They do not replace individual professional advice or an assessment by a human stylist.

Capsule does not guarantee that a recommended product, size, colour, style, combination, or fit will:

a. be suitable for you;

b. fit you correctly;

c. correspond exactly to its digital representation;

d. remain available for purchase; or

e. produce a particular styling result.

You remain responsible for evaluating recommendations and for purchase or styling decisions made on their basis.

Nothing in this section limits your statutory rights regarding goods or services purchased from Capsule. The liability provisions in Section 12 also apply.

6.4 Acceptable Use

When using Yves or another Capsule digital service, you agree not to:

a. submit unlawful, threatening, abusive, discriminatory, defamatory, obscene, or otherwise harmful content;

b. submit personal data, confidential information, or photographs belonging to another person without the necessary rights and permission;

c. upload photographs of minors;

d. impersonate another person or falsely represent your identity;

e. attempt to discover, extract, reproduce, manipulate, or reverse engineer the service’s underlying prompts, instructions, safeguards, system configuration, source code, or model behaviour;

f. circumvent message, session, technical, access, or usage limits;

g. access the service through bots, scripts, scraping tools, or other automated means without Capsule’s written permission;

h. interfere with the security, integrity, or operation of the service; or

i. use the service or its output to develop, train, benchmark, or operate a competing product or service.

6.5 Session Limits, Availability, and Suspension

Digital services may be subject to limits regarding the duration of sessions, number of messages, uploaded files, frequency of access, or available functionality. Capsule does not guarantee uninterrupted or error-free availability.

Capsule may modify, restrict, suspend, or discontinue a free digital service or particular functionality where reasonably necessary, including for technical, security, legal, operational, or commercial reasons.

Capsule may terminate or restrict an individual session or account where there is suspected misuse, a security risk, or a violation of these T&Cs.

6.6 Content Submitted to Digital Services

You retain any rights you hold in text, photographs, preferences, and other content that you submit.

You grant Capsule and its technical service providers a non-exclusive right to process the submitted content only as reasonably necessary to:

a. provide the service requested by you;

b. generate and deliver the requested output;

c. maintain the security and technical operation of the service;

d. prevent or investigate misuse; and

e. comply with applicable legal obligations.

You confirm that you have the necessary rights and permissions to submit the content and that doing so does not violate another person’s rights.

Personal data submitted through Yves is processed in accordance with Capsule’s Privacy Policy. The Privacy Policy explains the relevant processing purposes, categories of data, technical service providers, retention periods, international data transfers, and your data-protection rights. You should not submit unnecessary sensitive, confidential, financial, medical, or identifying information through Yves.

6.7 Intellectual Property

The Yves name and character, the Capsule website, the user interface, branding, written content, visual elements, system configuration, prompts, instructions, workflows, and other service components belong to Capsule and/or its licensors to the extent protected by applicable law or contractual rights.

You may use Yves and its output for your own personal, non-commercial purposes.

Except where expressly permitted by Capsule or mandatory law, no licence is granted to reproduce, distribute, sell, commercially exploit, extract, reverse engineer, or create competing services from these elements.

7. Prices and Payment

All prices are displayed in Swiss francs and include Swiss VAT where applicable.

Available payment methods are displayed at checkout.

The price applicable to an order is the price displayed when the order is submitted, subject to the correction of obvious pricing or technical errors.

8. Delivery

Delivery times are estimates unless Capsule expressly confirms a binding delivery date.

Capsule will inform customers of significant known delays. Capsule is not responsible for delays caused by circumstances outside its reasonable control.

9. Voluntary Returns Policy

Capsule offers a voluntary 14-day return policy for eligible items purchased in Switzerland. Returned products must be unworn, unused, in their original condition, and accompanied by proof of purchase. Exclusions may apply to products such as underwear, cosmetics, personalised products, and rental items.

Return shipping costs within Switzerland are covered by Capsule when the return is made using Capsule’s designated return process.

The procedure, eligibility requirements, and exclusions applicable to returns are set out in Capsule’s separate Return Policy. The voluntary return policy does not limit statutory rights concerning defective goods.

10. Warranty for Defects

Statutory rights relating to defective goods remain unaffected by Capsule’s voluntary return policy. Claims for defects in new goods are subject to a limitation period of two years from delivery.

For secondhand goods, the limitation period for claims for defects is reduced to one year from delivery. The secondhand warranty does not cover normal wear and tear, damage caused after delivery, or flaws and signs of use that were clearly disclosed in the product description, condition rating, or photographs before purchase.

Customers should inspect goods after delivery and notify Capsule promptly after discovering a suspected defect. Depending on the circumstances and the applicable legal requirements, remedies may include repair, replacement, a price reduction, cancellation of the purchase, or a refund. Manufacturer warranties, where available, may apply in addition to the rights provided by Capsule.

11. Privacy

Capsule processes personal data in accordance with its Privacy Policy.

The Privacy Policy applies to the use of the website, customer accounts, purchases, memberships, digital services, and Yves and forms an integral part of these T&Cs.

12. Liability

Capsule is liable without limitation where liability cannot lawfully be excluded or restricted.

In particular, nothing in these T&Cs excludes or restricts liability for intent or gross negligence or any other mandatory statutory liability.

To the extent permitted by law, Capsule excludes liability for:

a. indirect or consequential losses;

b. loss of profit, revenue, opportunity, or anticipated savings;

c. loss resulting from incorrect, incomplete, or unavailable AI-generated recommendations;

d. decisions or purchases made solely in reliance on digital or AI-generated output;

e. interruption or unavailability of free digital services; and

f. losses caused by circumstances outside Capsule’s reasonable control.

Where liability may lawfully be limited, Capsule’s liability for a paid digital service or membership is limited to the amount paid for the affected service or membership during the twelve months preceding the event giving rise to the claim.

13. Amendments

Capsule may amend these T&Cs where reasonably necessary, including to reflect changes to its services, business operations, technology, or applicable legal requirements.

Updated versions will be published on the website with a revised “Last updated” date.

Changes apply to future transactions and future use of the relevant services. Material changes affecting an existing paid membership will be communicated as described in Section 5.

14. Governing Law and Jurisdiction

These T&Cs are governed by Swiss law.

The courts of Zurich, Switzerland, have jurisdiction, subject to any mandatory statutory places of jurisdiction available to consumers.
